New Fee Structure including H1B, L1B Blocked
Good News! For the petitioners/employers as the new fee structure, including nonimmigrant petitions H-1B, L-1B and immigrant petitions, including I-140, I-485 which was to go into effect from Oct 2, 2020 has been blocked by the Federal District Court.
The new fee structure will increase costs for most employment-based petitioners and applicants along with the new version of form I-129.
Many applicants mainly India/China becomes eligible to file or looking to downgrade EB2 to EB3 and file I-140/ I-485 because of the rapid forward movement in the October Visa Bulletin may not be affected along with other nonimmigrant petitions.
The outcome of this news means, the petitioners and the applicants will not be subject to the higher fees or forms outlined in the regulation and can use old fee structure.
The Department of Labor (DOL) has decided to permanently implement the electronic issuance of PERM labor certifications. Employers will continue to receive certified PERMs via e-mail instead of through the U.S. post.
