Biden Immigration Executive Order

Biden signed three immigration executive orders. These EOs to undo the immigration policies and practices implemented by the Trump Administration. Also, Alejandro Mayorkas has been confirmed as U.S. Department of Homeland Security (DHS) secretary.

  • Undocumented immigrants

    • Create a Task Force to Reunify Families.

  • Asylum seekers

    • Develop a Strategy to Address Irregular Migration Across the Southern Border and Create a Humane Asylum System. 

  • Reviewing the Legal immigration system

    • Restore Faith in Our Legal Immigration System and Promote Integration of New Americans.

      • This Executive Order elevates the role of the White House in coordinating the federal government’s strategy to promote immigrant integration and inclusion, including re-establishing a Task Force on New Americans, and ensuring that our legal immigration system operates fairly and efficiently. The order requires agencies to conduct a top-to-bottom review of recent regulations, policies, and guidance that have set up barriers to our legal immigration system. It also rescinds President Trump’s memorandum requiring family sponsors to repay the government if relatives receive public benefits, instructs the agencies to review the public charge rule and related policies, and streamline the naturalization process.


There is nothing related to rescind Proclamations 10014 and 10052 currently extended till March 31, 2021.

P.P. 10014 suspends the entry to the United States of certain immigrant visa applicants, while P.P. 10052 suspends the entry to the United States of certain nonimmigrant visa applicants who present a risk to the U.S. labor market during the economic recovery following the novel coronavirus outbreak.  Specifically, the suspension in P.P. 10052 applies to applicants for H-1B, H-2B, and L-1 visas; J-1 visa applicants participating in the intern, trainee, teacher, camp counselor, au pair, or summer work travel programs; and any spouses or children of covered applicants applying for H-4, L-2, or J-2 visas.

Earlier, On January 25, 2021, President Biden signed an EO , entitled “Ensuring the Future Is Made in All of America by All of America’s Workers,” that seeks to encourage federal agencies to purchase goods made in America. One of the provisions of this order rescinds the “Buy America, Hire American” executive order signed by Trump in 2017.
